Aras silences in another crisis, and prosecutors demand action on road blocks

Members of the Federal Public Ministry, at different levels of the institution, demanded from the Attorney General of the Republic, Augusto Aras, “energetic action” in confronting the Bolsonarista protests that broke out after the defeat of Jair Bolsonaro (PL) at the polls. Ministers of the STF (Supreme Federal Court) also intensified behind the scenes charges to the PGR.

In one of the letters sent to him this Tuesday (1st), sub-attorneys of the Republic expressed “grave concern” with the acts carried out across the country.

“This unconstitutional state of affairs cannot be answered by the silence and inaction of public agents to whom the Constitution of the Republic grants the competence to defend the legal order and the democratic regime, demanding, therefore, the urgent and firm action of the Attorney General. General of the Republic”, said the signatories of the document.

After the publication of this report and with almost 48 hours of protests on the roads, Aras recorded a video on the subject and published it on his YouTube channel.

“We, members of the Brazilian MP, are committed to preserving freedom of expression, in a peaceful and orderly manner, in public places, without weapons, as the Constitution says,” he said.

“For this, we have made every effort since yesterday, Monday (31), to seek judicial decisions throughout Brazil and also from the Superior Court, so that the highways are released, preserving the supply, the order economy and the freedom to come and go. Peace and concord.”

Despite initiatives by the MPF against roadblocks and interdictions, including a request for measures to the Superior Electoral Court and a request for the opening of a police investigation so that the director general of the Federal Highway Police, Silvinei Vasques, be investigated for malfeasance, none of them was signed by Aras.

The deputy prosecutors warned of news that messages were circulating on digital networks, “spreading fake news that there had been fraud in the elections, inciting people to take to the streets and, with that, causing commotion and serious social instability”.

They also said that the participants of the protests on the roads, dissatisfied with the “legitimate” result of the presidential elections, invoke authoritarian interventions and “military coup”, “in an unequivocal framework of incitement to crime and the rupture of the constitutional order”.

A second document addressed to the attorney general this Tuesday, signed mainly by prosecutors of the Republic who act in the first instance, asks the PGR “to request the initiation of a police investigation with the objective of investigating the possible practice, by any authorities that enjoy jurisdiction of prerogative of function in the STF, of crimes related to the movements of blocking of roads”.

In a note released hours before the statement made via Youtube, the PGR had informed that Aras sent “guidance to all chief prosecutors of the Federal Public Ministry (MPF) to adopt the necessary measures to fully comply with the decision of Federal Supreme Court, for the immediate clearing of blocked roads in protest of the result of the presidential elections”.

“The purpose is to ensure that the movement does not undermine constitutional rights, such as the movement of the population, and that it does not affect the economy,” he said in the statement.

In the early evening, the Attorney General’s Office released a new note to inform that Aras had met, through an online conference, with the chief prosecutors of the MPF units.

At the meeting, according to the text, the PGR highlighted the efforts made by the Brazilian Public Ministry since Sunday night.

“The MPF is united around the solution of the crisis”, Aras said to colleagues, stressing that eventual responsibilities will be investigated.

The Prosecutor’s Office stated that any investigative measures must be taken in the first or second instance, depending on each situation, as they do not involve authorities with jurisdictional prerogatives in higher courts.
