The Ministry of Justice guided, this Thursday (12), the more than 900 units of Procons across the country to file administrative proceedings against Apple and Samsung, because the manufacturers stopped including battery chargers in the sale of their products. cell phones.
In a note, Senacon (National Consumer Bureau), an agency of the ministry, identified possible irregularities in the exclusion of shippers and asks the Procons to investigate and cover explanations from the companies. “Or even have to take the necessary measures to guarantee the satisfaction of national consumers”, said the Minister of Justice, Anderson Torres.
According to the national consumer secretary, Rodrigo Roca, the abrupt withdrawal of the chargers caused the São Paulo Procon to apply a fine of more than R$ 10.5 million against Apple, and the one in Fortaleza, R$ 26 million, an amount divided with the Samsung.
According to Senacon, if half of the Procons penalized each of the two manufacturers by R$ 10 million, they would pay around R$ 9 billion.
Two years ago, a bill (PL 5,451) has been going through the National Congress that proposes an adjustment to the Consumer Protection Code to oblige all manufacturers to keep chargers, batteries and headphones both in cell phones and in any electronics in which they are needed. .
Samsung says it has consistently responded to demands from consumer protection agencies regarding its charger policy and that consumers can pick up the equipment within 30 days of purchasing the cell phone.
