The MOE’s decision on the guilt of the 70-year-old man for sexual acts with a 6-year-old girl was taken by a majority of 4 to 3, with three of the four jurors ruling that the defendant should be declared innocent beyond reasonable doubt.
The court recognized the defendant’s prior cohabitation and reasonable trial violation. The Chief Prosecutor was opposed to the recognition of mitigating factors.
The musician in the first instance was sentenced for the case to 12 years in prison with the court granting him suspensive power on appeal.
In his speech a few days ago, the Chief Prosecutor of the MoE had characterized the decision of the first-instance court that found him guilty and sentenced him, giving him, “the possibility to move freely”, “a mistake” and a “procedural contradiction”.
