“The EAD issued ex officio its Audit Order legality of licensing and operation of Luna Park activitywhen during a preliminary investigation of a complaint involving the Luna Park, it was found that operates under a license granted in 2006, which has expired.
According to the findings of the audit, existence of legal residences at distances less than 150 m. (touching on the Luna Park and at a distance of up to 14 m.) and taking into account that as defined in no. 7034/1298/2000 KYA, the minimum operating distance of the Luna Park activity from the nearest legal residence (primary and secondary) cannot be less than 150 m, makes it clear that after the expiry of its then operating license in 2001, this it could not be renewed, much less granted a new one. The Luna Park business, for about five yearsfrom 2001 to 2006 operated without a legal license to operate in the midst of clashes with the locals, complaints, administrative obstacles and legal disputes. In addition, in 2002, the CoE had judged and rejected the suspension of execution of its shutdown, and its sealing was requested, among others, by the then Office of the Minister of the Ministry of Housing, the former S.E. .E.D.D. and the Prefecture of Athens-Piraeus. Due to the aforementioned, in 2006 the Municipality proceeded illegally to grant the controlled operating license.
On 20-07-2011competent police body found that the Luna Park was operating without a license from the competent Authority as the 2006 license had expired. From then until April 2022, for 11 years, the company operated under a decision suspending the execution of its sealing decision, despite the other violations of the terms of the license that had been established by the Municipality Services and other involved bodies. From the publication of the decision of the Athens Court of Appeal, in April 2022 and until the ex officio start of the EAD audit, the Luna Park was operating illegallyas first did not have a valid operating license and second it was operating until then based on the aforesaid decision suspending the execution of its seal which was valid until the Court of Appeal’s decision was issued. Hence the legitimate reason for its operation disappeared and the Municipality had to proceed with the definitive shutdown of its operation.
The initial position of the Directorate of Legal Affairs of the Municipality was that the operating license of the Luna Park was for an indefinite period, despite the fact that the indefinite validity was not provided for in any provision of law of the existing Luna Park activity licensing framework. During the audit, the opinion of the Directorate of Legal Affairs of the Municipality changed, recognizing that the 2006 license is no longer valid, as it was pointed out from the beginning by the control echelon. In addition, the audit team requested an on-site audit by the Directorate of Environment and Quality of Life and the Construction Service of the Municipality and an autopsy by the Athens Fire Services Administration. The Municipality Services found, among other things, discrepancy between the licensed and those found in the field of entertainment games, etcas well as variations in buildings, sizes, corridors, railings from the submitted plans for the issuance of said permit. also the business occupies an area designated as a road (zoned part of the property). The Athens Fire Services Administration, after a relevant autopsy, proceeded to revoke the company’s fire protection certificate and imposed an administrative fine for the violations.
During the audit, on 16-05-2023, the company was finally sealed, while preceded and the negative decision of the President of the First Instance regarding granting a temporary order suspending the execution of the decision to seal it”.
