Imprisonment sentences imposed by the Three-member Court of Appeal (b ́ degree) of Larissa on two brothers who were indicted for both robbery and robbery.

The two brothers were found guilty of the thefts which in two cases involved canaries that they stole from the houses of their fellow citizens with their own cage.

The 79-year-old sufferer testifying in court, he noted the attack he received from the two perpetrators, characteristically saying that after the blows “for… two hours I was dead”.

In the early hours of January 19, 2022, the 79-year-old man was awakened by the noise made by the bell he had installed on the roof of his single-family house, where the cages of songbirds, canaries, which were the pensioner’s hobby, were placed.

The two brothers, as the 79-year-old testified, from rooftop to rooftop reached his and with a “cage of their own”, “they emptied everything, I had 20 canaries, they hit me and left”. Showing his palm to the judges, where the doctors stitched up the wound caused by the attackers with a screwdriver, when he found them on the roof of his house stealing the canaries.

The defendants, as noted in the indictment, in order to keep the stolen goods, used physical violence against” the 79-year-old “and in particular they beat him violently, with their hands and feet, on the head, chest and back and in addition the they pushed with force, causing him to fall to the ground”, while one of the accused “using a screwdriver he was holding, hit the victim, while he was on the ground, on the inside of his right palm”.

ADDICTION PROBLEMS

“They beat me and they left, I was “dead” for two and a half hours, when I came to, I called, I was hospitalized for two weeks” he noted, in order to clarify to the Court, with regard to the motive of the theft, that the goldfinches are sold for 15 euros, while the canaries up to 30 euros.

Another witness testified that they also broke the door with a crowbar and stole the two canaries with characteristic colors, placing them in one of the cages, which canaries, however, were returned to him, and the two brothers were arrested as. Other witnesses testified that a bag was stolen from their home, while another witness testified that the two defendants are in the process of recovering from addictive substances.

The two defendants in their apologies referred to the addiction problems they face in the past, which is why they committed thefts to end up in prison. One brother apologized for their actions, asking the Court to give them “a second chance”, given the effort they are now making to escape the world of drugs. While the second defendant, also noting the addiction problems, denied the robbery charge. Noting, among other things, the acts confessed by the first defendant, the Prosecutor of the seat proposed their guilt, with the Three-member Court of Appeal of Larisa finding them guilty, imposing on the first defendant a prison sentence of 5 years and 12 months and a fine of 200 daily units to 5 euros and to the second defendant a sentence of 5 years imprisonment and 2 months imprisonment.
