Haris Tsiliotis spoke to News Bulletin 247 about the summoning of members of the Professional Sports Committee by the prosecutor on charges of breach of duty, for the infamous case of multi-ownership.
The vice-president of the EEA and Professor of Constitutional Law commented on the “Tuesday Appeal” show and Kyriakos Thomaidis on the happenings.
What he said in detail:
For his view on calling specific members of the EAA to explanations on the issue of multi-ownership: “I was not in the committee and I have not been called to give explanations. To establish a breach of duty, malice is required. Gross negligence is not enough. He is civilly liable only then.”
On whether the Panagopoulos complaint played a role in what concerns the fraud and the summons: “The complaint alone is not sufficient to create mere indications. We’re not talking about guilt. I want to emphasize for other publications that say that the inmates will sit on the stool and be held accountable, that this is not going to happen. They create impressions, we are not talking about defendants. I do not know her, but I have also been informed that Mr. Arkoudis has filed a lawsuit for defamation. I have the same opinion about Mr. Arkoudis, he is an excellent colleague, Mr. Panagopoulos’ complaint is obviously vague.”
On why the prosecutor accepted the preliminary examination: “It amazes me because I have followed the case. Based on the laws I know, if he has something in mind that I as a lawyer do not, or you as a journalist or a prosecutor, that is another matter. I have been a lawyer for 30 years, I can understand some things. From then on, if a criminal prosecution is brought, then the case will be decided by the three-member misdemeanor appeals court.”
On whether it is in his favor to have no pursuer: “This is reasonable, for this reason objections have been raised against the constitutionality. If anyone wants to object and support the charge, they cannot do so. Some bodies, such as these commissions and independent authorities, are vulnerable without any reason to completely unfounded lawsuits. It is not only the protection of persons, it is also the orderly functioning of the organs”.
