A court in New Mexico charged charges of negligent homicide to Alec Baldwin, for fatal gunshot wound to Alina Hutchins while filming the Western movie Rust near Santa Fe in October 2021.
Previous charges against the Emmy-winning actor were dropped last April, just two weeks before the trial was set to begin.
However, local prosecutors have since conducted further examination of the weapon used in the fatal shooting.
Baldwin’s lawyers told the BBC: “We look forward to the continuation of the trial.”
Baldwin, 65rehearsed a scene where he shoots a Colt .45.
But the gun went off, fatally hitting 42-year-old cinematographer Halyna Hutchins and injuring director Joel Souza.
The actor claimed he didn’t pull the trigger, he just pulled the trigger.
He has also maintained that he is not to blame for Hutchins’ death because he did not know that the gun contained cartridges and because he theoretically knew that there were no actual shots on the set.
But special prosecutors in New Mexico said in October that “additional evidence” had come to light after they commissioned medical examiners to reconstruct the gun, which had been broken during FBI testing.
They said the bullet could only go off if the trigger was pulled.
“Although Alec Baldwin repeatedly denies that he pulled the trigger, given the tests, findings and observations reported, the trigger had to be pulled or depressed enough to release a bullet“, their report concluded.
The new evidence was presented to a 12-judge jury, and the indictment was handed down on Friday.
If convicted, Baldwin faces up to 18 months in prison.
